By accessing or using Audibase ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
2. Description of Service
Audibase is a music community platform that allows users to share music, collaborate on projects, buy and sell digital content, discover events, and connect with other music enthusiasts. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.
3. User Accounts
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use of your account
- Be responsible for all activities that occur under your account
You must be at least 13 years old to create an account. If you are under 18, you must have parental consent.
4. User Content
Ownership: You retain ownership of the content you upload to the Platform. By uploading content, you grant Audibase a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content on the Platform.
Responsibility: You are solely responsible for the content you upload. You represent that you have all necessary rights to upload and share such content.
Prohibited Content: You agree not to upload content that:
- Infringes on any third party's intellectual property rights
- Is illegal, harmful, threatening, abusive, or harassing
- Contains hate speech or discriminatory content
- Is sexually explicit or pornographic
- Contains malware or harmful code
- Violates any applicable laws or regulations
5. Community Guidelines
Audibase is built on positivity and respect. Our motto is "Music = Peace, Love and Unity". When using the Platform, you agree to:
- Treat other users with respect and courtesy
- Not engage in harassment, bullying, or personal attacks
- Provide constructive feedback rather than destructive criticism
- Not spam or engage in deceptive practices
- Report any violations of these guidelines
6. Marketplace Transactions
Sellers: If you sell content on the Platform, you agree to accurately describe your products, deliver content as promised, and comply with all applicable tax laws.
Buyers: When you purchase content, you receive a licence to use that content according to the terms specified by the seller. Refund policies are set by individual sellers unless otherwise stated.
Fees: Audibase may charge fees for marketplace transactions. Current fee structures are available on our pricing page.
7. Intellectual Property
The Platform and its original content (excluding user-uploaded content), features, and functionality are owned by Audibase and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.
8. Copyright Infringement
We respect the intellectual property rights of others. If you believe that your copyrighted work has been uploaded to the Platform without authorisation, please contact us at [email protected] with details of the alleged infringement. We will investigate and take appropriate action, which may include removing the infringing content.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Platform will cease immediately. You may also delete your account at any time through your account settings.
10. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. Audibase makes no warranties, expressed or implied, regarding the Platform's operation, availability, or the information, content, or materials included therein.
11. Limitation of Liability
To the maximum extent permitted by law, Audibase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes by posting the updated terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new terms.
